Terms of Use and Privacy Policy

1. Definitions

For the purposes of this document, the following definitions apply: a) Family Account: an account model intended for household use, linked to one or more Player Profiles, under the responsibility of a responsible adult or legal guardian. b) Professional Account: an account model intended for professionals, institutions, or service providers, with features for managing multiple Player Profiles. c) Player Profile: a set of usage records and data linked to a player or user registered on the Platform, which may include behavioral, progress, and interaction information, without direct personal identification. d) Games: interactive experiences made available on the Platform, including, without limitation, Mapa das Emoções (Emotion Map) and Laboratório da Calma (Calm Lab). e) Subscription: a recurring-billing arrangement that unlocks access to certain games, content, features, and updates. f) User: any person who accesses or uses the Platform, including a family guardian, legal guardian, professional, institution, or authorized representative. g) Data Subject: the natural person to whom the personal data processed by Autigames relates. h) Legal guardian: a father, mother, tutor, guardian, or other representative legally entitled to consent to, supervise, or be responsible for the use of the Platform by a child or adolescent, where applicable. i) User Content: texts, records, notes, answers, choices, interactions, or any information entered on the Platform by the User, including in professional environments. j) Personal data: any information related to an identified or identifiable natural person, including indirect identifiers, usage records, and behavioral data associated with access. k) Child and adolescent data: personal data of individuals under 12 years of age, in the case of a child, or between 12 and 18 years of age, in the case of an adolescent, as defined by applicable law.

2. Purpose of the Platform

Autigames is a digital platform of interactive games focused on socio-emotional and educational development, designed to support the development of the emotional, social, and behavioral skills of its players.

Autigames is not a medical, therapeutic, or diagnostic device, does not replace psychological, psychiatric, pedagogical, speech-language, occupational, or clinical care, and does not provide reports, diagnoses, prescriptions, or individualized professional recommendations.

3. Eligibility, Accounts, and Responsibilities

3.1. General eligibility Use of the Platform is subject to full acceptance of this document and, where applicable, the creation of a valid account and the purchase of a Subscription. The User declares that all information provided to Autigames is true, complete, and up to date, and commits to keeping it so.

3.2. Family Account The Family Account offers: Creation of a Player Profile with progress tracking Free access to the Mapa das Emoções game Possible access to other games with an active subscription Access to all games included in the subscription and future updates The Family Account is intended for household use and must be created, managed, and supervised by a responsible adult or legal guardian. The person responsible for the Family Account declares to be at least 18 years old and assumes responsibility for the use of the Platform by children and adolescents linked to the account, including age suitability, supervision, access management, and other controls required by applicable law. Autigames may adopt proportional age-confirmation and/or responsibility-validation mechanisms when necessary for security, fraud prevention, protection of minors, or legal compliance.

3.3. Professional Account The Professional Account allows: Plans with a limit of up to: 5 profiles 10 profiles More than 10 profiles Individualized management of Player Profiles Specific selection of: Game Character Day or interaction stage The Professional Account is intended for professionals, institutions, or service providers authorized to use the Platform in a technical, educational, institutional, or care-related context. The User of the Professional Account declares to have the authority and permission to manage the Player Profiles linked to the account and to enter User Content, including private notes, in compliance with applicable law, the duty of confidentiality, the relevant legal bases, and the ethical and professional limits of their activity. Notes, records, and information entered in the Professional Account are the sole responsibility of the User who enters them, without prejudice to the security, availability, and data-processing obligations undertaken by Autigames as controller, processor, or mere intermediary, depending on the nature of the data flow in each case.

4. Acceptable Use Rules

The User is prohibited from: a) using the Platform for unlawful, fraudulent, abusive, discriminatory, defamatory, offensive, violent purposes, or purposes contrary to applicable law; b) circumventing age, security, authentication, parental control, access limitation, or feature restriction mechanisms; c) entering, transmitting, or sharing illegal, pornographic, sexually explicit, violent, hateful, harassing, exploitative, intimidating content, content that encourages self-harm or self-injurious behavior, or other material unsuitable for children and adolescents; d) attempting to access, copy, modify, exploit, decompile, reverse-engineer, or interfere with the Platform, its code, databases, models, features, or infrastructure; e) using the Platform for automated collection, scraping, mining, improper indexing, mass extraction, or unauthorized reuse of content, data, or metadata; f) compromising the integrity, stability, security, or availability of the Platform; g) using the Platform in a manner incompatible with its educational and socio-emotional purpose.

Autigames may suspend, restrict, or terminate accounts, profiles, or access in the event of a breach of this document, indication of fraud, abuse, risk to minors, legal requirement, or a determination by a competent authority.

5. Personal Data and Privacy

Autigames adopts the principles of purpose, adequacy, necessity, transparency, security, prevention, non-discrimination, and accountability, under applicable law.

5.1. What data may be processed Depending on the use of the Platform and the features enabled, Autigames may process: a) registration data of the guardian, professional user, or authorized representative, such as name, email, phone number, company, institution, and other data necessary for contracting, identification, and support; b) authentication and access data, such as login, password, session records, IP, date and time of access, device identifiers, and technical logs; c) usage and browsing data, such as interactions, progress, choices, functional preferences, usage events, performance metrics, errors, and technical occurrences; d) data entered by the User on the Platform, including User Content and notes in the Professional Account; e) payment and billing data, where applicable, subject to the flows operated by third parties responsible for payment processing; f) communications with Autigames through support, security, cancellation, or rights-exercise channels.

5.2. Data of children and adolescents When the Platform is used by or for children and adolescents, data processing will observe the best interests of the minor, progressive autonomy, priority protection, and the safeguards required by applicable law. Autigames will seek to limit processing to what is strictly necessary for the operation of the Platform, for service security, for functional personalization compatible with the stated purpose, and for compliance with legal or regulatory obligations. When necessary, Autigames may adopt proportional mechanisms for age verification, legal-guardian validation, parental supervision, and feature restriction, including to prevent improper access to content, resources, or environments incompatible with the user's age group.

5.3. Purposes of processing Personal data may be processed for the following purposes: a) account creation, administration, and authentication; b) provision of the contracted services and availability of the Platform's features; c) operation of Player Profiles, including progress, evolution, and functional preferences; d) technical support, user assistance, fraud prevention, and information security; e) compliance with legal, regulatory, contractual, and judicial obligations; f) improvement, maintenance, correction, auditing, performance analysis, and development of the Platform; g) billing, invoicing, subscription, renewal, cancellation, and refund management, where applicable; h) the regular exercise of rights in administrative, judicial, or arbitration proceedings; i) communication with users about updates, security alerts, contractual changes, and relevant service information.

5.4. Legal bases Autigames will process personal data based on the applicable legal grounds, especially Law No. 13,709/2018 (General Data Protection Law – LGPD) and, when it concerns children and adolescents or a product/service likely to be accessed by that audience, also in accordance with Law No. 15,211/2025 (Digital Statute of the Child and Adolescent – ECA Digital), observing the best interests of the minor and the relevant legal safeguards. Processing activities may rely, as applicable, on: performance of a contract, compliance with a legal or regulatory obligation, the regular exercise of rights, legitimate interest, where applicable and compatible with law, and consent, where required. When it comes to the data of children and adolescents, in addition to the LGPD, the duties of priority protection, best interests, enhanced transparency, minimization, and additional safeguards set out in the ECA Digital will prevail.

5.5. Data sharing Autigames does not sell personal data and does not share data with third parties for behavioral advertising or commercial enrichment purposes. Any sharing will occur only when strictly necessary for the operation of the Platform, payment processing, hosting, information security, technical support, compliance with a legal or regulatory obligation, the regular exercise of rights, or by order of a competent authority, always under criteria of necessity, purpose, and security.

5.6. International transfer Should data be processed, stored, or accessed by providers located outside Brazil, Autigames will adopt contractual, technical, and organizational safeguards compatible with applicable law.

5.7. Retention and deletion Personal data will be stored for as long as necessary to fulfill the stated purposes, to meet legal, regulatory, and contractual obligations, and for the regular exercise of rights. Once the applicable retention period has ended, data may be deleted, anonymized, or kept blocked, where applicable and permitted by law.

5.8. Rights of data subjects Under applicable law, the data subject may request, where applicable: a) confirmation of the existence of processing; b) access to the data; c) correction of incomplete, inaccurate, or outdated data; d) anonymization, blocking, or deletion of unnecessary, excessive, or non-compliant data; e) portability, subject to regulatory limits; f) information about sharing; g) information on the possibility of not providing consent and its consequences; h) withdrawal of consent, when that is the applicable legal basis; i) review of automated decisions, where they exist and as provided by law.

6. Cookies and Similar Technologies

Autigames may use cookies, pixels, SDKs, and similar technologies for authentication, security, operation of the Platform, usage analysis, functional personalization, and improvement of the user experience. The User may manage cookie preferences, depending on the available technology, without prejudice to the operation of strictly necessary features.

7. Subscriptions, Billing, and Cancellation

7.1. Subscription Some games, content, features, or updates may require an active Subscription. The price, frequency, renewal conditions, and included features will be disclosed clearly and prominently at the time of purchase.

7.2. Billing Billing may occur monthly, on a recurring basis, or as set out in the contracted plan, including through app stores or third-party payment gateways.

7.3. Cancellation Cancellation may be requested at any time, through the channels made available by Autigames or the applicable purchase channel. Unless otherwise required by law or a specific technical rule of the payment method, cancellation will take effect at the end of the already-contracted cycle, without prejudice to access already paid for through that date. Any refund policies will follow applicable law and the rules of the applicable purchase channel, where relevant.

8. Intellectual Property

All content of the Platform, including games, characters, narratives, interfaces, layouts, texts, images, illustrations, trademarks, visual elements, source code, structural bases, distinctive signs, and other protected assets, belongs to Autigames or its licensors, and is protected under applicable intellectual property law. Reproduction, modification, distribution, commercialization, disclosure, decompilation, reverse engineering, automated use, or any unauthorized exploitation of the Platform's content, in whole or in part, is prohibited. Use of the Platform does not transfer to the User any intellectual property right over its elements, trademarks, features, or content.

9. Liability and Limitations

Autigames will make reasonable efforts to keep the Platform available, secure, and functional, without guaranteeing the total absence of failures, interruptions, or unavailability arising from technical factors, third parties, force majeure, or scheduled maintenance.

Autigames will not be liable for: a) misuse of the Platform by the User or by third parties; b) incorrect, incomplete, or outdated information provided by the User; c) damages arising from a breach of this document, usage instructions, or security requirements; d) content, decisions, interpretations, or conduct adopted by the User based on the use of the Platform; e) failures by third parties, including providers, payment methods, app stores, and telecommunications services, without prejudice to the User's rights against the responsible provider, where applicable.

Nothing in this clause shall be interpreted as excluding or limiting liability in cases prohibited by applicable law.

10. Information Security and Incidents

Autigames adopts reasonable technical and organizational measures compatible with the current state of the art to protect data and systems, including, as applicable, access control, encryption, event logging, monitoring, credential management, backups, and internal security policies. In the event of a security incident involving relevant risk or damage, Autigames will adopt containment, investigation, and remediation measures and, when required, will notify the competent authorities and affected data subjects, under applicable law.

11. Moderation, Reports, and Abuse

Autigames may maintain reporting channels and internal moderation mechanisms to identify, review, and address abusive use, attempted fraud, rights violations, inappropriate content, and conduct incompatible with this document. Misuse of the reporting mechanisms or the submission of false information may result in proportional measures, including restriction of access, suspension, or cancellation of the account, without prejudice to applicable legal remedies.

12. Changes to This Document

Autigames may amend this document at any time, by publishing the updated version on the Platform. When a change materially affects rights, obligations, or the processing of personal data, Autigames will take reasonable steps to inform users through an appropriate channel. Continued use of the Platform after the new version takes effect will constitute awareness and acceptance, without prejudice to any need for a new acceptance where required by law or by the nature of the change.

13. Governing Law and Jurisdiction

This document is governed by the laws of the Federative Republic of Brazil. The courts of the Judicial District of Porto Alegre/RS are hereby elected, with the parties waiving any other jurisdiction, however privileged it may be, except where applicable law requires a different venue or specific competence rule.
